Terms and Conditions of Sale – Professional Cleaning Services

 

Article 1 – Purpose and Scope

 

These Terms and Conditions of Sale (hereinafter referred to as “TCS”) define the terms and conditions under which MAGE (hereinafter referred to as “the Provider”) offers professional cleaning services (hereinafter referred to as “the Services”) to businesses and professionals (hereinafter referred to as “the Client”).

 

These TCS apply to all professional cleaning services provided by MAGE via direct contracts, the website agencemage.fr, or any other distribution channel. They exclude any other contractual terms unless agreed otherwise in writing.

 

Article 2 – Description of Services

 

2.1 Service Details

 

MAGE provides cleaning and maintenance services for offices, commercial spaces, and other professional premises. The exact scope of each service is defined in the contract or quote and may include:

• Regular maintenance cleaning (vacuuming, dusting, disinfecting surfaces, emptying trash, etc.),

• Deep cleaning and sanitation,

• Window and glass cleaning,

• Specific cleaning upon request (e.g., post-renovation, event cleanup, etc.).

 

2.2 Service Frequency and Modalities

 

The Services can be provided:

• On a recurring basis (daily, weekly, monthly),

• As a one-time intervention for specific needs,

• During or outside business hours, based on the Client’s requirements.

 

The Client will be informed in advance of the cleaning schedule and any specific requirements related to the service.

 

Article 3 – Orders and Contract Formation

 

3.1 Service Request and Quote

 

The Client may request a service quote via agencemage.fr, by phone, or through direct contact. Each quote specifies:

• The nature of the Services,

• The service frequency and duration,

• The price (excluding and including tax),

• Any special terms or additional costs.

 

3.2 Order Confirmation

 

The contract is considered final once the Client has approved the quote and accepted these TCS via electronic validation, signature, or written confirmation.

 

3.3 Modifications

 

Any modification to the service agreement (schedule, frequency, type of service) must be requested in writing by the Client and accepted by the Provider.

 

Article 4 – Pricing and Payment Terms

 

4.1 Pricing

 

Service prices are fixed in the quote or contract and may vary depending on:

• The size of the premises,

• The frequency and complexity of the cleaning,

• Additional services requested.

 

4.2 Payment Terms

• Payment is due as per the invoice terms (monthly, per service, or as agreed).

• Accepted payment methods: bank transfer, direct debit, check.

• Late payments may incur penalties in accordance with Article L.441-10 of the French Commercial Code.

 

4.3 Price Adjustments

 

MAGE reserves the right to adjust pricing annually to reflect inflation, increased costs, or legal requirements.

 

Article 5 – Service Execution

 

5.1 Obligations of the Provider

 

MAGE commits to:

• Providing trained and qualified cleaning professionals,

• Using appropriate and eco-friendly cleaning products,

• Respecting safety and hygiene regulations.

 

5.2 Access and Client Cooperation

 

The Client must provide safe and reasonable access to the premises for cleaning staff. If access is denied or unavailable, the Provider cannot be held liable for incomplete service.

 

5.3 Equipment and Supplies

• Unless otherwise specified, MAGE provides its own cleaning products and equipment.

• If the Client prefers specific products or materials, they must be supplied at their own cost.

 

Article 6 – Cancellation and Rescheduling

 

6.1 Cancellation by the Client

• For a scheduled service: Cancellations must be notified at least 48 hours in advance. Failure to do so may result in a 50% service fee charge.

• For contract termination: The Client must provide 30 days’ written notice unless otherwise stated in the agreement.

 

6.2 Cancellation by the Provider

 

If the Provider cancels due to force majeure or unforeseen circumstances, the Client will be notified promptly, and an alternative service date will be offered.

 

6.3 Rescheduling

 

The Client may request to reschedule a service subject to availability. If a rescheduling request is made less than 24 hours before the scheduled service, a rescheduling fee may apply.

 

Article 7 – Liability and Insurance

 

7.1 Liability of the Provider

 

MAGE is only responsible for damages resulting directly from its Services. The Provider is not liable for:

• Damage caused by pre-existing conditions of the Client’s premises,

• Incidents caused by third-party interference or use of unauthorized cleaning products.

 

7.2 Insurance Coverage

 

MAGE holds professional liability insurance covering any damage caused during service execution. A certificate of insurance can be provided upon request.

 

Article 8 – Confidentiality and Data Protection

 

8.1 Confidentiality

 

MAGE commits to maintaining the confidentiality of all Client information accessed during service execution.

 

8.2 Personal Data

 

Client data is collected solely for service administration and is processed in compliance with GDPR regulations. Clients may request access, correction, or deletion of their personal data by contacting MAGE.

 

Article 9 – Dispute Resolution

 

9.1 Applicable Law

 

These TCS are governed by French law.

 

9.2 Mediation and Litigation

 

In the event of a dispute:

• Parties will first attempt an amicable resolution.

• If no resolution is found, disputes shall be referred to the commercial courts of Nanterre, unless otherwise stated by law.

 

Article 10 – Acceptance of Terms

 

By contracting cleaning services from MAGE, the Client fully accepts these Terms and Conditions of Sale without reservation.
