Terms and Conditions of Use

Welcome to MAGE, an application developed by MAGE SAS, a simplified joint-stock company (SAS) registered with the Nanterre Trade and Companies Register under number 930 066 402, with its headquarters located at 126 rue Perronet, Neuilly-sur-Seine, 92200.

 

The use of the MAGE application is subject to these General Terms and Conditions of Use (GTCU), which you accept by using our services. These GTCU define the conditions under which users (providers and clients) can access the services offered on our platform.

 

1. Purpose

 

These GTCU aim to define the rights and obligations of MAGE application users, whether they are providers or clients, as well as the rules for using the platform as a service mediation tool for personal services.

 

2. Definitions

    •    Application: Refers to the MAGE mobile application and affiliated websites agencemage.com and agencemage.fr, which offer identical or similar services.

    •    User: Refers to any person, whether a provider or a client, who uses the application.

    •    Client: Refers to any individual or entity using the application to request a personal service.

    •    Provider: Refers to any individual or entity registered on the application to provide personal services.

    •    Mandate: MAGE acts as a mandate, facilitating the connection between clients and providers.

 

3. Registration and Account

 

3.1 Registration Requirements

 

Registering on the application requires creating a user account via a registration form available on the platform. The information provided during registration must be accurate and complete.

 

3.2 Confidentiality of Login Details

 

Login credentials (email address and password) are personal and confidential. Users agree not to share them with third parties. MAGE cannot be held responsible for unauthorized account use.

 

4. Services Offered

 

The MAGE application allows clients to search for and book personal services provided by providers. Services include, but are not limited to:

    •    Recurring cleaning,

    •    One-time or emergency cleaning,

    •    Childcare,

    •    Handyman services,

    •    Gardening,

    •    IT assistance, etc.

 

Providers registered on the application must provide services in compliance with current regulations and must be declared (e.g., SIRET number for self-employed providers).

 

5. Application Usage

 

5.1 Operation of the Connection Service

 

The application allows clients to choose a provider and book services through the application. MAGE acts as a mandate, facilitating this connection, but does not directly participate in the performance of services.

 

5.2 User Obligations

 

Clients agree to use the application to book services that comply with current laws, while providers agree to provide quality services in accordance with their contractual commitments.

 

5.3 Penalties for Breach of Commitments

 

In case of repeated contractual breaches or poor service quality, MAGE reserves the right to suspend or delete the provider’s account after notification. Providers must ensure that services comply with current laws and meet expected quality standards. Providers must also respect commitments to clients, including deadlines, presence, and service execution.

 

5.4 Proof of Right to Work

 

By registering and using the MAGE application, providers certify that they have the legal right to work in France in compliance with current legislation. MAGE cannot be held liable for false declarations regarding this right. It is the client’s responsibility, in the case of a CESU contract, to verify the provider’s right to work.

 

6. Prices and Payments

 

6.1 Service Prices

 

Service prices are displayed on the application at the time of booking.

 

The hourly rate for services offered through the MAGE application is set directly by the platform. Prices are determined based on several criteria, such as the type of service, desired net pay for providers, social charges, and applicable commission. Users (clients and providers) accept that these rates are non-negotiable and set by MAGE. The platform reserves the right to modify prices at any time, with prior notice to users.

 

6.2 Secure Payment

 

Payments made through the application are secured by our payment partner Stripe. MAGE does not store any bank details directly.

 

6.3 Payment Methods

 

Clients can pay for services through:

    •    Credit card,

    •    Bank transfer,

    •    CESU (Universal Service Employment Check).

 

MAGE charges a commission on each completed service.

 

7. Complaints and Cancellations

 

7.1 Complaints

 

For complaints regarding a service, users can contact customer support via email at contact@agencemage.com. Complaints will be processed as soon as possible.

 

7.2 Cancellations

 

Cancellation conditions are specified at the time of booking. Late cancellations may incur fees in accordance with the cancellation policy displayed in the application.

 

8. Personal Data Protection

 

8.1 Data Collection and Processing

 

MAGE is committed to complying with current data protection regulations, including the General Data Protection Regulation (GDPR). The data collected is used solely in connection with the services offered by the application.

 

8.2 Purpose of Data

 

Personal data is used for:

    •    User account management,

    •    Service and payment management,

    •    Improving user experience.

9. Intellectual Property

 

All elements of the MAGE application (texts, graphics, logos, images, etc.) are protected by intellectual property law. Any reproduction, in whole or in part, without permission is strictly prohibited.

 

10. Liability

 

10.1 MAGE’s Liability

 

As a mandate, MAGE cannot be held responsible for the quality of services performed by providers. In case of a dispute regarding a service, the client and provider must resolve the matter directly.

 

10.2 Limitation of Liability

 

MAGE disclaims any liability for indirect damages such as lost income, non-material damages, or damages resulting from poor service execution. As a mandate, MAGE cannot be held responsible for the quality of services provided by providers.

 

10.3 Client Responsibility in the CESU Framework

 

In the context of CESU contracts, the client is considered the legal employer of the provider and is responsible for all administrative and legal formalities related to this employment, including verifying the provider’s right to work.

 

11. Subscription System for CESU Services

 

11.1 Subscription for Regular Services (Part-Time or Full-Time)

 

When hiring a CESU provider through the MAGE application for regular services (part-time or full-time), a subscription system may be offered to adjust the commission-related costs.

 

Clients wishing to employ a provider regularly, part-time, or full-time, may opt for a monthly or annual subscription.

 

11.2 Subscription Terms

 

The subscription includes the following benefits:

    •    A discount on the commission applied to regular services.

    •    Personalized tracking of services for employer clients.

    •    Priority access to certain providers based on demand.

 

Subscription rates and terms are detailed in the application and may vary depending on the type of service and frequency of intervention.

 

11.3 Subscription Payment

 

The subscription amount is debited monthly or annually via the payment method provided by the client. In case of subscription termination, the client must inform MAGE at least 30 days before the renewal date.

 

11.4 Subscription Termination

 

Clients can terminate their subscription at any time, provided they give 30 days’ notice before the next due date. Termination will end the benefits associated with the subscription, and the standard commission will apply to future services.

 

12. Modification of GTCU

 

MAGE reserves the right to modify these GTCU at any time. Users will be informed of any modifications via the application.

 

13. Right to Refuse GTCU Modifications

 

In case of changes to these GTCU, users may refuse these modifications. A refusal will result in the termination of the user account with a 30-day notice, during which the previous conditions will remain in effect.
